As the 2005 season approaches we believe the maps
show that the town right of way exists in pretty much as it had
been described in lore. For this reason we think that kiteboarders
should be allowed to access the harbor at Pocomo Point.
Also we believe that Massachusetts State
Law supports our clear right to access the harbor from Pocomo Point.
According to Massachusetts law "The
right to navigate includes the right to conduct any activity involving
the movement of a boat, vessel, float, or other watercraft, as well
as the transport of people and materials and related loading and
unloading activity;" which means that a Kiteboard, which
is considered a vessel by Massachusetts Law has the right to load
and unload from Pocomo Point, which means the launch and land, and
thereby access the harbor.
